How to Appeal Medford Municipal Court – Not a Court of Record

1) Fill out the forms

  • Complete “Notice of Appeal from Municipal or Justice Court.”
    • Use the party names exactly as shown on your Municipal Court judgment or order (Plaintiff and Defendant).
    • You are also the Appellant (the person appealing). Your party type stays the same (Plaintiff stays Plaintiff; Defendant stays Defendant).
    • Include the Municipal Court case number.
  • If you are low-income, you may ask the Circuit Court to waive or defer fees by filing:
    • Application for Fee Deferral or Waiver.
    • Note: There is no filing fee to appeal a misdemeanor case.

2) Make copies

  • Make one copy of everything for your records (you may need additional copies for service).

3) File your appeal with Municipal Court

  • File the Notice of Appeal with the Municipal Court and serve copies on the City Attorney's Office (in person or by mail).
  • The Municipal Court will notify the Circuit Court of your appeal.

4) Pay the filing fee (if required) or request a waiver or deferral

  • Misdemeanor appeals are free.
  • For all other cases you must pay the filing fee of $281 to the Municipal Court or submit the fee waiver or deferral application with your Notice of Appeal.
  • You are responsible to ensure the fee is paid, waived, or deferred (the Circuit Court will process waiver and/or deferral requests and give next steps if denied).
